Article 1 – Purpose

These general terms and conditions of sale (hereinafter referred to as “the General Terms and Conditions of Sale”) aim to define the reciprocal rights and obligations of M'eye'R Trading and Internet users making a purchase on the Website (hereinafter referred to as “the Customer”). The General Terms and Conditions of Sale apply automatically to all online sales of Products sold and shipped (hereinafter “the Products”) by M'eye'R Trading via the Website. These General Terms and Conditions exclusively govern the relationship between the Customer and M'eye'R Trading. Any document other than these General Terms and Conditions of Sale, including catalogs, brochures, advertisements, and notices, is for informational and indicative purposes only and is not contractually binding. M'eye'R Trading reserves the right to modify the General Terms and Conditions of Sale at any time. They will then be applicable as soon as they are posted online. In the event of modification, the General Terms and Conditions of Sale in force on the date of the order will be applied to each order.

Article 2 – Products

The Products are offered for sale by M'eye'R Trading as long as they are visible on the Website and while stocks last. If a Product is unavailable, M'eye'R Trading undertakes to inform the Customer as soon as possible. The essential characteristics of the Products are described and presented as accurately as possible. The Products comply with the regulations in force relating to the safety and health of persons, fair trading, and consumer protection at the time they are placed on the market.

Article 3 – Prices

The prices of our Products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order). The prices indicated are guaranteed while stocks last. Product prices do not include shipping and packaging costs. Shipping and packaging costs will be invoiced in addition and will be specified before the order is confirmed. If one or more taxes or contributions, particularly environmental taxes, are created or modified, either upwards or downwards, this change may be reflected in the sale price of the Products on the Website and in the various sales media. However, prices cannot be changed once your order has been confirmed. For orders to countries other than mainland France, the Customer is the importer of the Product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of M'eye'R Trading. They shall be borne by the Customer and are his sole responsibility, both in terms of declarations and payments to the relevant authorities and bodies in your country. M'eye'R Trading advises the Customer to check with his local authorities about these aspects. All orders, regardless of their origin, are payable in euros. M'eye'R Trading reserves the right to modify its prices at any time, but the Product will be invoiced on the basis of the price in effect at the time of order confirmation, subject to Product availability. The Products remain the property of M'eye'R Trading until full payment of the price. Please note: as soon as the Customer takes physical possession of the Products ordered, the risk of loss or damage to the Products is transferred to them.

Article 4 – Orders

4.1 Prior identification.

To place an initial order on the Website, the Customer must create an account by filling out a form containing the following information: title, last name, first name, Customer's address, delivery address (if different from the Customer's address), email address, telephone number, and password for the Website. M'eye'R Trading is responsible for processing personal data. The information collected is processed electronically to enable the identification of users of the website www.9five-europe.com and to facilitate navigation on the said website. The recipient of the data is M'eye'R Trading. In order to respect the Customer's privacy, their personal data is kept for as long as necessary for the purpose of processing. M'eye'R Trading undertakes to keep the Customer's bank details for the duration of the transaction only, after which they will be deleted. In accordance with the French Data Protection Act of January 6, 1978, amended in 2004, the Customer has the right to access and rectify information concerning them, which they may exercise by contacting M'eye'R Trading – Customer Service – info@9five-europe.com. The Customer may also, for legitimate reasons, object to the processing of data concerning them. From the second order onwards, the Customer must fill in a form providing only their email address and password, which were provided during the first order. The Customer expressly agrees to provide M'eye'R Trading with accurate and truthful information about themselves.

4.2 Order registration and confirmation.

To place an order, the Customer must follow the procedure below: – Select the desired Product(s) and add them to the shopping cart. – Once the shopping cart has been confirmed, the Customer must choose an address and payment method, this last step formalizing the sales contract with M'eye'R Trading. – In order to definitively confirm their order and proceed with payment, the Customer must first expressly accept the General Terms and Conditions of Sale by checking the box provided for this purpose, located next to a hyperlink to the said General Terms and Conditions of Sale. Any order confirmation implies the Customer's full and complete acceptance of these general terms and conditions of sale, without exception or reservation. – Payment Acceptance of the General Terms and Conditions of Sale and confirmation of the order by the Customer constitute the contract between M'eye'R Trading and the Customer. Any order implies acceptance of the prices and descriptions of the Products available for sale. M'eye'R Trading will acknowledge receipt of the order and payment as soon as it has been confirmed by the Customer by sending an electronic acknowledgment of receipt, which serves as confirmation of the order. This email will again contain a hyperlink to these General Terms and Conditions of Sale. In certain cases, particularly in the event of non-payment, an incorrect address, or any other problem related to your account, M'eye'R Trading reserves the right to block the Customer's order until the problem is resolved. If a Product ordered is unavailable, the Customer will be informed by email after payment. The cancellation of the order for this Product and any refund (via the payment method used at the time of purchase) will then be made no later than thirty days after payment by the Customer, with the rest of the order remaining firm and final. M'eye'R Trading reserves the right to refuse any order if the quantities of Products ordered are abnormally high for buyers who are consumers. Furthermore, the Website is not intended to sell its Products in large quantities. For any questions regarding the tracking of an order, the Customer may consult their account on the Website or send an email to info@9five-europe.com.

4.3 Order modifications.

Any modification to an order by the Customer after confirmation of their order is subject to acceptance by M'eye'R Trading. This modification must be requested by the customer within 24 hours of placing their order by email to the following address: info@9five-europe.com.

Article 5 – Payment

By confirming the order, the Customer agrees to pay the price indicated on the order confirmation appearing on the Website at the time of payment. Payment is due in full after confirmation of the order by the Customer. This confirmation constitutes signature and express acceptance of all transactions carried out on the Website by the Customer. The online provision of the credit card number and the final confirmation of the order shall constitute proof of the order placed, in accordance with Article 1316-1 of the Civil Code. Payment for purchases is made exclusively by credit card (Carte Bleue, Visa, Mastercard) using the secure Caisse d'Epargne system or the PayPal system. The Customer must provide their credit card number, its expiry date and the security code (three-digit number on the back of the credit card). The card will only be debited when the order is shipped. In the event of split deliveries, only the Products shipped will be debited. In the event of fraudulent use of the Customer's credit card, the Customer is invited to contact Customer Service at info@9five-europe.com as soon as such use is detected.In the event of a dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of payment authorization by banking institutions, non-payment or partial payment, or use of a credit card not issued by a French financial institution, M'eye'R Trading may refuse to fulfill the order placed. The Customer will be notified by email. M'eye'R Trading cannot be held liable in any way for any of the above cases of order refusal.

Article 6 – Delivery

6.1. Order processing time.

All orders are processed within 3 business days of order confirmation. An email is sent to the customer when their order is shipped.

6.2. Delivery terms.

The Products are shipped with the delivery note to the delivery address specified by the Customer when placing the order.

– Delivery in mainland France: a quote will be provided to the Customer before the order is confirmed. Delivery times are indicated on the order confirmation. In the event of a delay in shipment, an email will be sent to the Customer to inform them of any possible impact on the delivery time indicated. In the event of a delay in delivery, the order is not automatically canceled. M'eye'R Trading cannot be held liable for delivery delays due to malfunctions of the aforementioned transport services. In the case of deliveries by a carrier, M'eye'R Trading cannot be held liable for delivery delays due exclusively to the Customer's unavailability after several attempts to arrange a delivery appointment. In the event of excessive delivery delays due to postal services or means of transport, as well as in the event of strikes or loss of the Products ordered, any complaints made by Customers will be analyzed on a case-by-case basis. Articles L138-2 and 3 of the Consumer Code: Delivery delays exceeding fourteen days that are not due to force majeure may result in the cancellation of the sale by the Customer, who, within sixty working days of the specified delivery date, may cancel their order by registered letter with acknowledgment of receipt, return the products if they have been delivered in the meantime, and receive a refund from M'eye'R Trading within thirty days at the latest for their payment and shipping costs, excluding any compensation.

6.3. Transfer of risk.

Any risk of loss or damage to the Product(s) is transferred to the Customer at the moment when the Customer, or a third party designated by the Customer, takes physical possession of these Products. When the Customer entrusts the delivery of the goods to a carrier other than the one proposed by M'eye'R Trading, the risk of loss or damage to the Product(s) is transferred to the Customer upon delivery of the Product(s) to the carrier. In the event that transport is provided by M'eye'R Trading, the latter invites the Customer to express reservations upon receipt of a damaged package (packaging bearing visible signs of opening and/or deterioration), failing which the Customer will be held responsible for damage to the Product(s) received.

Article 7 – Cancellation

7.1. Right of cancellation and return policy.

In accordance with the provisions of Article L.121-21 of the Consumer Code, the Customer has a withdrawal period of 14 days from receipt of your Products to exercise their right of withdrawal without having to justify their reasons or pay a penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions) within 14 days. In this context, the Customer is liable. Any damage to the Product during this process may invalidate the right of withdrawal. To exercise their right of withdrawal, the Customer may make any unambiguous statement indicating their intention to return the Product to M'eye'R Trading. M'eye'R Trading will acknowledge receipt of the Customer's withdrawal by email. The Customer must then return the Products to M'eye'R Trading, no later than fourteen (14) days after your withdrawal, by post to the following address: M'eye'R Trading – 18 route de Bondy – 93600 AULNAY SOUS BOIS. You are responsible for the return shipping costs.

7.2. Refund.

M'eye'R Trading undertakes to refund the Customer for all sums paid upon receipt of their package. M'eye'R Trading will refund the Customer for the returned Products, subject to compliance with the above conditions, as well as the standard delivery costs for the Products if you return your entire order. The refund will be made via the payment method used for the returned order. For example, if the order for Products was paid for by credit card and the Customer's credit card is still valid, the refund will be made to the account linked to that credit card.

Article 8 – Warranty

All Products sold on the Website are covered by the legal warranty of conformity (L211-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the Customer to return Products that are defective or non-compliant. The Customer is informed that M'eye'R Trading, whose registered office is located at 18 route de Bondy, 93600 AULNAY SOUS BOIS, France, is the guarantor of the conformity of the Products under these two legal warranties. The Customer has a period of two years from the delivery of the Product to take action under the legal warranty of conformity. In this case, the Customer may request replacement of the Product, subject to the cost conditions provided for in Article L 211-9 of the Consumer Code. If the Product is unavailable, a refund will be made (according to the payment method used at the time of purchase). The Customer is exempt from providing proof of the existence of the lack of conformity of the Product during the 12 months following delivery of the Product. Furthermore, the Customer may decide to implement the warranty against hidden defects in the item sold within the meaning of Article 1641 of the Civil Code. In this case, the Customer may choose between cancellation of the sale (return of the Product against refund) or a reduction in the sale price (refund of part of the price of the Product) in accordance with Article 1644 of the Civil Code.

Article 9 – Implementation of warranties

Claims made under the legal warranties mentioned in Article 8 of these Terms and Conditions must be sent, within the specified time limits, by email to M'eye'R Trading's customer service department at the following address: info@9five-europe.com  or by post to the following address: M'eye'R Trading – Customer Service – 18 route de Bondy – 93600 AULNAY SOUS BOIS France. M'eye'R Trading will review the complaint and respond within thirty days to proceed, if necessary, with replacement or refund (depending on the method of payment used at the time of purchase) and in the event that the defect or damage to the Product is not the fault of the Customer. If the complaint is accepted by M'eye'R Trading's customer service department, the latter undertakes to reimburse the shipping costs in the event of the return of the Product(s). Where applicable, the Customer must return the Product(s) intact (original packaging, accessories, instructions, etc.). Returned Products without postage will not be accepted. Products must be returned by post to the following address: M'eye'R Trading – 18 route de Bondy – 93600 AULNAY SOUS BOIS. M'eye'R Trading declines all responsibility in the event that the Product and the package are damaged during transport by a third party, particularly in the event of an unforeseeable and insurmountable event or in the event of force majeure.

 Article 10 – Responsibilities and force majeure

The Products offered comply with current French legislation. Furthermore, M'eye'R Trading cannot be held liable for damage resulting from misuse of the purchased Product by the Customer. Similarly, M'eye'R Trading cannot be held liable in the event of non-performance or poor performance of the contract due to the Customer. As such, M'eye'R Trading declines all responsibility and cannot be held liable in any way for errors, omissions, spelling mistakes, or typos in the documents provided by the Customer. Finally, M'eye'R Trading cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruption, external intrusion, or the presence of computer viruses. The performance by M'eye'R Trading of all or part of its obligations shall be suspended in the event of force majeure that would hinder or delay performance. The various cases recognized by French case law are considered as such. In such cases, M'eye'R Trading will inform the Customer by email within seven days of the event occurring. The computerized records stored in M'eye'R Trading's computer systems under reasonable security conditions will be considered proof of communications, orders, and payments between the Customer and M'eye'R Trading. Purchase orders and invoices are archived on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.

Article 11 – Dispute resolution

11.1. Complaints.

All complaints must be addressed to M'eye'R Trading's customer service department: info@9five-europe.com.

11.2. Mediation.

If the complaint submitted to customer service is unsuccessful or if customer service fails to respond within two months, the Customer may submit the dispute relating to the application, interpretation, or execution of these General Terms and Conditions of Sale, the purchase order, or the payment of the price, opposing M'eye'R Trading, to a mediator who will attempt, independently and impartially, to bring the parties together with a view to reaching an amicable solution. The parties to the contract remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator.

11.3. Territorial jurisdiction and applicable law.

These General Terms and Conditions of Sale are subject to French law. The language of the contract between the Customer and M'eye'R Trading is French. Therefore, in the event of a dispute concerning the application, interpretation, or execution of these General Terms and Conditions of Sale, the order form, or payment of the price, the competent court shall be that of the defendant's place of residence or that of the actual delivery of the Product.

Article 12 – Intellectual property

All elements of the www.9five-europe.com website are and remain the exclusive intellectual property of M'eye'R Trading. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether visual or audio, or the underlying technology. These elements are protected by copyright, trademark law, and patent law. Any simple or hypertext link is strictly prohibited without the express prior written consent of M'eye'R Trading. Any reproduction, exploitation, distribution, or use for any purpose whatsoever, even partial, of elements of the Website, whether visual or audio, or even the underlying technology, without the express prior authorization of M'eye'R Trading, exposes offenders to legal proceedings. The sale of the Products does not in any way entail the transfer to the Customer of intellectual property rights, in particular all copyrights, designs and models, trademarks, and patents attached to the Products and exclusively owned by M'eye'R Trading. Any reproduction, exploitation, distribution, or use for any purpose whatsoever, even partially, of all or part of the intellectual property rights attached to M'eye'R Trading's Products without the express prior authorization of M'eye'R Trading exposes the offending Customer to legal proceedings and engages their liability.

Article 13 – Confidentiality of personal data

The information requested from the Customer is necessary for processing the order.
