We will entrust the product(s) you have purchased to a regular carrier in our warehouse in France, for shipment to the destination you have chosen. Allow 5 working days (metropolitan France and the European Union) to receive your package once your order has been validated; 8 to 12 working days for an order issued outside the European Union or from overseas territories.

We have selected a carrier with an excellent transportation history and that we believe provides a high degree of protection. You will receive title and assume all risks of loss and damage to the products from the time they are handed over to the carrier. However, shipped packages have a tracking number that will be provided to you by the carrier. You can thus closely monitor the progress of your delivery and use this tracking number for any request for additional information, both from the carrier and from our customer service.

Article 1 – Purpose

These general terms and conditions of sale (hereinafter referred to as "the General Terms and Conditions of Sale") aim to define the reciprocal rights and obligations of M'eye'R Trading and Internet users making a purchase on the Website (hereinafter referred to as "the Customer"). The General Terms and Conditions of Sale apply automatically to any online sale of Products sold and shipped (hereinafter "the Products") by M'eye'R Trading via the Website. These General Terms and Conditions exclusively govern the Customer's relationship with M'eye'R Trading. Any document other than these General Terms and Conditions of Sale, and in particular catalogues, prospectuses, advertisements and notices, has only an informative and indicative value, not contractual. M'eye'R Trading reserves the right to modify the General Terms and Conditions of Sale at any time. They will then be applicable as soon as they are posted online. In the event of modification, the General Terms and Conditions of Sale in force on the day of the order will be applied to each order.

Article 2 – Products

The Products are offered for sale by M'eye'R Trading as long as they are visible on the Website and within the limit of available stocks. In the event of the Product not being available, M'eye'R Trading undertakes to inform the Customer as soon as possible. The essential characteristics of the Products are described and presented with the greatest possible accuracy. The Products comply with the requirements in force relating to the safety and health of people, the fairness of commercial transactions and the protection of consumers at the time they are placed on the market.

Article 3 – Price

The prices of our Products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order). The prices indicated are guaranteed within the limit of available stocks. The prices of the Products are exclusive of shipping and packaging costs. The amount of shipping and packaging costs will be invoiced in addition and will be specified before validation of the order. If one or more taxes or contributions, in particular environmental ones, were to be created or modified, either upwards or downwards, this change may be reflected in the sale price of the Products present on the Website and on the various sales media. However, a price cannot be modified once your order has been validated. In the event of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of M'eye'R Trading. They will be the responsibility of the Customer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. M'eye'R Trading advises the Customer to inquire about these aspects with their local authorities. All orders, regardless of their origin, are payable in euros. M'eye'R Trading reserves the right to modify its prices at any time, but the Product will be invoiced on the basis of the rate in effect at the time of validation of the order, subject however to the availability of the Product. The Products remain the property of M'eye'R Trading until full payment of the price. Please note: as soon as the Customer takes physical possession of the Products ordered, the risks of loss or damage to the Products are transferred to them.

Article 4 – Orders

4.1 Prior identification.

To place a first order on the Website, the Customer must create an account by completing a form containing the following information: title, surname, first name, address of the Customer, delivery address (if different from the Customer's address), email, telephone number and password for the Website. M'eye'R Trading is responsible for processing personal data. The information collected is subject to computer processing intended to allow the identification of the user of the website www.9five-europe.com, to facilitate navigation on said site. The recipient of the data is M'eye'R Trading . In order to respect the privacy of the Customer, his personal data is kept for the entire duration necessary for the purpose of the processing. M'eye'R Trading undertakes to keep the Customer's banking data for the duration of the transaction only, beyond which, they will be deleted. In accordance with the "Informatique et Libertés" law of 6 January 1978, amended in 2004, the Customer has the right to access and rectify information concerning him/her, which he/she may exercise by contacting M'eye'R Trading – Customer Service – info@9five-europe.com. He/she may also, for legitimate reasons, object to the processing of data concerning him/her. From the second order, the Customer must complete a form by providing only his/her email address and password, provided during the first order. The Customer expressly undertakes to provide M'eye'R Trading with sincere and fair information concerning him/her.

4.2 Registration and validation of the order.

To place an order, the Customer must follow the following procedure: – Select the desired Product(s) and add them to the basket. – Once the basket has been validated, the Customer must choose an address and payment method, this last step formalizing the sales contract with M'eye'R Trading . – In order to definitively validate his order and proceed to payment, the Customer must first expressly accept the General Conditions of Sale by checking the box provided for this purpose, located near a hyperlink referring to said General Conditions of Sale. Any order confirmation entails the Customer's full and complete acceptance of these general conditions of sale, without exception or reservation. – Payment The acceptance of the General Conditions of Sale and the confirmation of the order by the Customer form the contract between M'eye'R Trading and the Customer. Any order constitutes acceptance of the prices and descriptions of the Products available for sale. M'eye'R Trading will acknowledge receipt of the order and its payment upon validation by the Customer by sending, electronically, an acknowledgement of receipt serving as confirmation of the order. In this email, a hyperlink will again be present referring to these General Terms and Conditions of Sale. In certain cases, in particular for non-payment, incorrect address or any other problem related to your account, M'eye'R Trading reserves the right to block the Customer's order until the problem is resolved. In the event of unavailability of a Product ordered, the Customer will be informed by email after payment. The cancellation of the order for this Product and its possible refund (by the means of payment used at the time of purchase), will then be made at the latest within thirty days following payment by the Customer, the remainder of the order remaining firm and final. M'eye'R Trading reserves the right to refuse any order if the quantities of Products ordered are abnormally high for buyers with the status of consumers. In addition, the Website is not intended to sell its Products in large quantities. For any questions relating to the tracking of an order, the Customer can consult his account on the Website or send an email to info@9five-europe.com.

4.3 Modification of the order.

Any modification of the order by the Customer after confirmation of the order is subject to acceptance by M'eye'R Trading . This modification must be requested by the customer within 24 hours of the order by email to the following address: info@9five-europe.com.

Article 5 – Payment

Validating the order implies for the Customer the obligation to pay the price indicated on the order confirmation appearing on the Website at the time of payment. Payment is due in full after confirmation of the order by the Customer. This validation constitutes signature and express acceptance of all operations carried out on the Website by the Customer. The online provision of the bank card number and the final validation of the order will constitute proof of the order placed, in accordance with article 1316 – 1 of the Civil Code. Payment for purchases is made by bank card exclusively (Carte Bleue, Visa, Mastercard) using the secure system of Caisse d'Epargne or by the Paypal system. The Customer must provide their bank card number, the expiry date of the card and the cryptogram number (three-digit number on the back of the bank card). The card is only debited when the order is shipped. In the event of split deliveries, only the Products shipped are debited. In the event of fraudulent use of the Customer's bank card, the Customer is invited, as soon as this use is noted, to contact Customer Service info@9five-europe.com. In the event of an existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of payment authorization by banking organizations, non-payment or partial payment, or use of a bank card not issued by a French financial institution, M'eye'R Trading may refuse to honor the order placed. The Customer will be notified by email. M'eye'R Trading cannot then be held liable under any circumstances for all of the aforementioned cases of order refusal.

Article 6 – Delivery

6.1. Order processing time.

All orders are processed within 3 (business) days of order validation. An email is sent to the customer when their order is shipped.

6.2. Delivery terms.

The Products are shipped with the delivery note to the delivery address indicated by the Customer when ordering.

– Delivery in mainland France: a quote will be specified to the Customer before confirming the order. Delivery times are indicated on the order acknowledgement. In the event of a delay in shipping, an email will be sent to the Customer to inform them of any possible consequences on the delivery time indicated to them. In the event of a delay in delivery, the order is not automatically cancelled. M'eye'R Trading cannot be held responsible for delivery delays due to malfunctions of the aforementioned transport services. In the event of deliveries by a carrier, M'eye'R Trading cannot be held responsible for delivery delays due exclusively to the Customer's unavailability after several proposed appointments. In the event of excessive delivery times due to postal services or means of transport, as well as in the event of a strike or loss of the Products ordered, any complaints made by Customers will be analyzed on a case-by-case basis. Articles L138-2 and 3 of the Consumer Code: A delay in delivery exceeding fourteen days and not due to a case of force majeure may result in the cancellation of the sale by the Customer, who, within sixty working days from the indicated delivery date, will cancel his order by registered letter with acknowledgement of receipt, return the products if they have been delivered in the meantime and will receive from M'eye'R Trading no later than thirty days the refund of his payment and shipping costs, excluding any compensation.

6.3. Transfer of risk.

Any risk of loss or damage to the Product(s) is transferred to the Customer at the time the latter, or a third party designated by the Customer, takes physical possession of these Products. When the Customer entrusts the delivery of the goods to a carrier other than the one proposed by M'eye'R Trading , the risk of loss or damage to the Product(s) is transferred to the Customer upon delivery of the Product(s) to the carrier. In the event that the transport is assumed by M'eye'R Trading , the latter invites the Customer to issue reservations upon receipt of a damaged package (packaging showing visible signs of opening and/or deterioration) under penalty of being considered responsible for the damage to the Product(s) received.

Article 7 – Withdrawal

7.1. Right of withdrawal and return procedures.

In accordance with the provisions of Article L.121-21 of the Consumer Code, the Customer has a withdrawal period of 14 days from receipt of your Products to exercise their right of withdrawal without having to provide reasons or pay a penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions) within 14 days. In this context, the Customer is liable. Any damage suffered by the Product on this occasion may be such as to defeat the right of withdrawal. To exercise their right of withdrawal, the Customer may make any unambiguous declaration indicating their intention to return the Product to M'eye'R Trading . M'eye'R Trading will acknowledge receipt of the Customer's withdrawal by email. The Customer must then return the Products to M'eye'R Trading , at the latest within fourteen (14) days following your withdrawal, by La Poste to the following address: M'eye'R Trading – 18 route de Bondy – 93600 AULNAY SOUS BOIS. The return costs via La Poste are your responsibility.

7.2. Reimbursement.

M'eye'R Trading undertakes to reimburse the Customer for the full amount paid upon receipt of their package. M'eye'R Trading will reimburse the Customer for the returned Products, subject to compliance with the conditions mentioned above, as well as the standard "outbound" delivery costs for the latter if you return your entire order. The reimbursement will be made via the payment method used when the order was returned. Thus, for example, if the order for Products was paid for by credit card, and the Customer's credit card is still valid, the reimbursement will be made to the account attached to this credit card.

Article 8 – Warranty

All Products for sale on the Website benefit from the legal guarantee of conformity (L211-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the Customer to return Products delivered that are defective or non-compliant. The Customer is informed that M'eye'R Trading , whose head office is at 18 route de Bondy 93600 AULNAY SOUS BOIS, is the guarantor of the conformity of the Products within the framework of these two legal guarantees. The Customer has a period of two years from the delivery of the Product to act in application of the legal guarantee of conformity. In this case, the Customer may request the replacement of the Product, subject to the cost conditions provided for in article L 211-9 of the Consumer Code. In the event of unavailability of the Product, a refund will be made (according to the means of payment used at the time of purchase). The Customer is exempt from providing proof of the existence of the lack of conformity of the Product during the 24 months following delivery of the Product. Furthermore, the Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, the Customer may choose between the resolution of the sale (return of the Product against reimbursement) or a reduction in the sale price (reimbursement of part of the price of the Product) in accordance with Article 1644 of the Civil Code.

Article 9 – Implementation of guarantees

Claims made under the legal guarantees mentioned in Article 8 of these General Terms and Conditions must be sent, within the time limits, by email to M'eye'R Trading 's customer service at the following address: info@9five-europe.com or by post to the following address: M'eye'R Trading – Customer Service – 18 route de Bondy – 93600 AULNAY SOUS BOIS France. M'eye'R Trading will study the claim and respond within thirty days to proceed, if necessary, with the replacement or refund (depending on the payment method used at the time of purchase) and in the event that the defect or deterioration of the Product is not the fault of the Customer. In the event that the claim is accepted by M'eye'R Trading 's customer service, the latter undertakes to reimburse the shipping costs in the event of the return of the Product(s). Where applicable, the Customer must return the Product(s) intact (original packaging, accessories, instructions, etc.). Products returned without postage will not be accepted. In the event that the Product and the package are damaged during transport by a third party, in particular in the event of an unforeseeable and insurmountable event and in the event of force majeure, M'eye'R Trading declines all liability.

Article 10 – Responsibilities and force majeure

The Products offered comply with current French legislation. Furthermore, M'eye'R Trading cannot be held liable for damages resulting from improper use of the Product purchased by the Customer. Similarly, M'eye'R Trading cannot be held liable in the event of non-performance or improper performance of the contract due to the Customer. As such, M'eye'R Trading declines all liability and may not be held liable under any circumstances for errors, omissions or spelling or typing mistakes in the documents provided by the Customer. Finally, M'eye'R Trading cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including a service outage, external intrusion or the presence of computer viruses. The performance by M'eye'R Trading of all or part of its obligations will be suspended in the event of force majeure that would hinder or delay its performance. The various cases recognized by French case law are considered as such. In such a case, M'eye'R Trading will inform the Customer by email within seven days of the occurrence of the event. The computerized records, stored in M'eye'R Trading 's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the Customer and M'eye'R Trading . The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.

Article 11 – Dispute Resolution

11.1. Complaint.

11.2. Mediation.

In the event of failure of the claim request to the customer service or in the absence of a response from this service within two months, the Customer may submit the dispute relating to the application, interpretation or execution of these General Conditions of Sale, the purchase order or the payment of the price, opposing it to M'eye'R Trading to a mediator who will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution. The parties to the contract remain free to accept or refuse recourse to mediation as well as, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator.

11.3. Territorial jurisdiction and applicable law.

These General Terms and Conditions of Sale are subject to French law. The language of the contract concluded between the Customer and M'eye'R Trading is French. Also, in the event of a dispute concerning the application, interpretation or execution of these General Terms and Conditions of Sale, the purchase order or the payment of the price, the competent court will be that of the place of domicile of the defendant or that of actual delivery of the Product.

Article 12 – Intellectual property

All elements of the site www.9five-europe.com are and remain the intellectual and exclusive property of M'eye'R Trading . No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether visual or audio, or the underlying technology. These elements are protected by copyright, trademark law and patent law. Any simple or hypertext link is strictly prohibited without the express prior written consent of M'eye'R Trading . Any reproduction, exploitation, dissemination, or use for any purpose whatsoever, even partially, of the elements of the Website whether visual or audio, or even the underlying technology, without the express prior authorization of M'eye'R Trading exposes offenders to legal action. The sale of the Products does not in any case entail the transfer, for the benefit of the Customer, of intellectual property rights and in particular all copyrights, designs and models, trademarks, patents attached to the Products and of which M'eye'R Trading is the exclusive owner. Any reproduction, exploitation, distribution or use for any purpose whatsoever, even partially, of all or part of the intellectual property rights attached to the Products of M'eye'R Trading , without the express prior authorization of M'eye'R Trading , exposes the offending Customer to legal proceedings and incurs its liability.

Article 13 – Confidentiality of personal data

The information requested from the Customer is necessary for processing the order.
