We will entrust the product(s) you have purchased to a regular carrier in our warehouse in France, for shipment to the destination you have chosen. Allow 5 working days (Metropolitan France and European Union) to receive your package once your order has been validated; 8 to 12 working days for an order placed outside the European Union or from overseas territories.

We have selected a carrier with an excellent transport history and which we believe provides a high degree of protection. You will receive title and assume all risk of loss and damage to the products from the time they are handed over to the carrier. However, the parcels shipped have a tracking number that will be communicated to you by the carrier. You can thus closely follow the progress of your delivery and use this tracking number for any request for additional information, both from the carrier and from our customer service department.

Article 1 - Purpose

These general terms and conditions of sale (hereinafter referred to as "the General Terms and Conditions of Sale") are intended to define the mutual rights and obligations of M'eye'R Trading and Internet users making a purchase on the Website (hereinafter referred to as "the Client"). The General Terms and Conditions of Sale shall automatically apply to any online sale of Products sold and shipped (hereinafter referred to as "the Products") by M'eye'R Trading through the Website. These General Terms and Conditions exclusively govern the relationship between the Client and M'eye'R Trading. Any document other than these General Terms and Conditions of Sale, and in particular catalogues, prospectuses, advertisements and notices, is for information and guidance only, and is not binding. M'eye'R Trading reserves the right to modify the General Terms and Conditions of Sale at any time. They will then be applicable as soon as they are put online. In case of modification, the General Terms and Conditions of Sale in force on the day of the order will be applied to each order.

Article 2 - Products

The Products are offered for sale by M'eye'R Trading as long as they are visible on the Website and within the limits of available stocks. If the Product is not available, M'eye'R Trading undertakes to inform the Client as soon as possible. The essential characteristics of the Products are described and presented with the greatest possible accuracy. The Products comply with the requirements in force relating to the safety and health of persons, the fairness of commercial transactions and consumer protection at the time they are placed on the market.

Article 3 - Prices

The prices of our Products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order). The prices indicated are guaranteed within the limits of available stocks. The prices of the Products are exclusive of postage and packaging. The amount of shipping and packaging costs will be invoiced in addition and will be specified before validation of the order. If one or more taxes or contributions, in particular environmental taxes or contributions, are created or modified, upwards or downwards, this change may be reflected in the sale price of the Products on the Website and on the various sales media. However, a price cannot be modified once your order has been confirmed. In the event of an order to a country other than metropolitan France, the Customer is the importer of the Product or Products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of M'eye'R Trading. They will be the responsibility of the Client and are his sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. M'eye'R Trading advises the Client to inquire about these aspects with its local authorities. All orders, regardless of their origin, are payable in euros. M'eye'R Trading reserves the right to modify its prices at any time, but the Product will be invoiced on the basis of the price in force at the time of validation of the order, subject nevertheless to the availability of the Product. The Products remain the property of M'eye'R Trading until full payment of the price. Attention: as soon as the Customer physically takes possession of the ordered Products, the risk of loss or damage to the Products is transferred to him.

Article 4 - Orders

4.1 Pre-identification.

To place a first order on the Website, the Customer must create an account by filling in a form containing the following information: title, surname, first name, Customer's address, delivery address (if different from the Customer's address), email address, telephone number and password for the Website. M'eye'R Trading is responsible for processing personal data. The information collected is processed for the purpose of identifying the user of the www.9five-europe.com website and facilitating navigation on the site. The recipient of the data is M'eye'R Trading. In order to respect the Customer's privacy, his personal data is kept for as long as necessary for the purpose of processing. M'eye'R Trading undertakes to keep the Customer's bank details only for the duration of the transaction, after which they will be deleted. In accordance with the French Data Protection Act of January 6, 1978, amended in 2004, the Customer has the right to access and rectify information concerning him/her, which he/she may exercise by contacting M'eye'R Trading - Customer Service - [email protected]. They may also, for legitimate reasons, object to the processing of their personal data. As of the second order, the Customer must fill in a form, mentioning only his e-mail address and password, communicated at the time of the first order. The Customer expressly undertakes to provide M'eye'R Trading with true and fair information about him or herself.

4.2 Registration and validation of the order.

To place an order, the Customer must follow the following procedure: - Select the desired Product(s), and add them to the shopping cart. - Once the basket has been validated, the Customer must choose an address and the method of payment, this last step formalizing the sales contract with M'eye'R Trading. - In order to definitively validate the order and proceed with payment, the Customer must first expressly accept the General Terms and Conditions of Sale by ticking the box provided for this purpose, located near a hypertext link to the said General Terms and Conditions of Sale. Any order confirmation implies the Customer's full acceptance of these General Terms and Conditions of Sale, without exception or reservation. - Payment Acceptance of the General Sales Conditions and confirmation of the order by the Customer form the contract between M'eye'R Trading and the Customer. Any order implies acceptance of the prices and descriptions of the Products available for sale. M'eye'R Trading will acknowledge receipt of the order and its payment as soon as it has been validated by the Customer, by sending an electronic acknowledgement of receipt confirming the order. This e-mail will again contain a hypertext link to the present General Terms and Conditions of Sale. In certain cases, notably for non-payment, incorrect address or any other problem linked to your account, M'eye'R Trading reserves the right to block the Customer's order until the problem has been resolved. In the event of unavailability of an ordered Product, the Customer will be informed by email after payment. The cancellation of the order of this Product and its possible refund (by the means of payment used at the time of the purchase), will then be carried out at the latest in the thirty days following the payment by the Customer, the remainder of the order remaining firm and definitive. M'eye'R Trading reserves the right to refuse any order if the quantities of Products ordered are abnormally high for buyers with the status of consumers. Furthermore, the website is not intended to sell Products in large quantities. For any questions relating to the tracking of an order, the Customer may consult his account on the Website or send an e-mail to [email protected].

4.3 Modification of the order.

Any modification of the order by the Customer after confirmation of the order is subject to acceptance by M'eye'R Trading. This modification must be requested by the customer within 24 hours of placing the order by email to the following address: [email protected].

Article 5 - Payment

The act of validating the order implies the Customer's obligation to pay the price indicated on the order confirmation appearing on the Website at the time of payment. Payment is due in full upon confirmation of the order by the Customer. This validation constitutes signature and express acceptance of all operations carried out on the Internet Site by the Customer. The on-line provision of the credit card number and the final validation of the order shall constitute proof of the order placed, in accordance with article 1316 - 1 of the French Civil Code. Payment for purchases is made exclusively by credit card (Carte Bleue, Visa, Mastercard) via the Caisse d'Epargne secure system, or via the Paypal system. Customers must provide their credit card number, expiry date and cryptogram number (the three-digit number on the back of the card). The card will only be debited when the order is dispatched. In the case of split deliveries, only the Products shipped are debited. In the event of fraudulent use of the customer's bank card, the customer is invited to contact Customer Service [email protected] as soon as this is discovered. In the event of an existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal to authorize payment by banking organizations, non-payment or partial payment, or use of a bank card not issued by a French financial institution, M'eye'R Trading may refuse to honor the order placed. The Customer will be notified by e-mail. M'eye'R Trading cannot be held responsible for any of the aforementioned cases of order refusal.

Article 6 - Delivery

6.1. Order processing time.

All orders are processed within 3 working days of order validation. An email is sent to the customer when the order is shipped.

6.2. Delivery terms and conditions.

The Products are shipped with the delivery note to the delivery address indicated by the Customer when ordering.

- Delivery in metropolitan France: a quotation will be specified to the Customer before the order confirmation. Delivery times are indicated on the acknowledgement of receipt of the order. In the event of a delay in shipment, an email will be sent to the Customer to inform him of any possible consequences on the delivery time indicated to him. In the event of late delivery, the order is not automatically cancelled. M'eye'R Trading cannot be held automatically responsible for delivery delays due to malfunctions in the aforementioned transport services. In the event of deliveries by a carrier, M'eye'R Trading cannot be held responsible for late delivery due exclusively to the unavailability of the Client after several appointments. In the event of excessive delivery time due to postal services or means of transport, as well as in the event of a strike or loss of the Products ordered, any complaints made by Customers will be analysed on a case-by-case basis. Articles L138-2 and 3 of the Consumer Code: The delay in delivery exceeding fourteen days and not due to force majeure may result in the cancellation of the sale by the Customer, who, within sixty working days from the indicated delivery date, will renounce his order by registered letter with acknowledgement of receipt, will return the products if they have been delivered in the meantime and will receive from M'eye'R Trading at the latest within thirty days the refund of his payment and shipping costs, excluding any compensation.

6.3. Transfer of risk.

Any risk of loss or damage to the Product(s) is transferred to the Customer at the time the Customer, or a third party designated by the Customer, physically takes possession of the Product(s). When the Customer entrusts the delivery of the goods to a carrier other than that proposed by M'eye'R Trading, the risk of loss or damage of the Product(s) is transferred to the Customer upon delivery of the Product(s) to the carrier. In the event that M'eye'R Trading is responsible for the transport, M'eye'R Trading invites the Client to express reservations as soon as it receives a damaged package (packaging bearing visible traces of opening and/or deterioration), otherwise it will be considered responsible for the damage of the Product(s) received.

Article 7 - Withdrawal

7.1. Right of withdrawal and return terms.

In accordance with the provisions of Article L. 121-21 of the Consumer Code, the Customer has a withdrawal period of 14 days from the receipt of your Products to exercise his right of withdrawal without having to justify any reasons or pay any penalty. Returns must be made in their original and complete condition (packaging, accessories, instructions) within 14 days. In this context, the Client is liable. Any damage suffered by the Product on this occasion may be of such a nature as to defeat the right of withdrawal. To exercise its right of withdrawal, the Customer may make any unambiguous statement indicating its intention to return the Product to M'eye'R Trading. M'eye'R Trading will acknowledge receipt of the Client's withdrawal by email. The Customer must then return the Products to M'eye'R Trading, at the latest within fourteen (14) days following your withdrawal, by La Poste to the following address: M'eye'R Trading - 18 route de Bondy - 93600 AULNAY SOUS BOIS. You are responsible for the cost of returning the goods via La Poste.

7.2. Reimbursement.

M'eye'R Trading undertakes to reimburse the Client for all sums paid upon receipt of the package. M'eye'R Trading will refund the Customer the returned Products, subject to compliance with the above-mentioned conditions, as well as the standard "one-way" delivery costs of the latter if you return your entire order. The refund will be made via the payment method used for the returned order. Thus, for example, if the order for Products has been paid for by credit card, and the Customer's credit card is still valid, the refund will be made to the account attached to this credit card.

Article 8 - Guarantee

All Products sold on the Website benefit from the legal guarantee of conformity (L211-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing the Customer to return defective or non-conforming Products delivered. The Client is informed that M'eye'R Trading, whose registered office is 18 route de Bondy 93600 AULNAY SOUS BOIS is the guarantor of the conformity of the Products under these two legal guarantees. The Customer has a period of two years from the delivery of the Product to act pursuant to the legal guarantee of conformity. In this case, the Customer may request the replacement of the Product, subject to the cost conditions provided for in Article L 211-9 of the Consumer Code. In case of unavailability of the Product, a refund will be made (depending on the payment method used at the time of purchase). The Customer is exempted from providing proof of the existence of the lack of conformity of the Product during the 24 months following the delivery of the Product. In addition, the Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of Article 1641 of the French Civil Code. In this case, the Customer may choose between cancelling the sale (return of the Product on delivery) or reducing the sale price (refund of part of the price of the Product) in accordance with Article 1644 of the French Civil Code.

Article 9 - Implementation of guarantees

Claims made under the legal warranties mentioned in article 8 of these GCS must be sent, within the specified time limits, by e-mail to M'eye'R Trading's customer service department at the following address: [email protected] or by post to the following address: M'eye'R Trading - Service Client - 18 route de Bondy - 93600 AULNAY SOUS BOIS France. M'eye'R Trading will investigate the claim and respond within thirty days to proceed, if appropriate, with replacement or refund (depending on the payment method used at the time of purchase) and assuming that the defect or deterioration of the Product is not due to the Customer. If the complaint is accepted by M'eye'R Trading's customer service department, M' eye'R Trading undertakes to reimburse shipping costs if the Product(s) is/are returned. Where applicable, the Customer must return the Product(s) intact (original packaging, accessories, instructions, etc.). Products returned without postage will not be accepted. Products must be returned by post to the following address: M'eye'R Trading - 18 route de Bondy - 93600 AULNAY SOUS BOIS. M' eye'R Trading declines all responsibility in the event that the Product and the parcel are damaged during transport by a third party, in particular in the event of unforeseeable and insurmountable circumstances and in the event of force majeure.

Article 10 - Responsibilities and force majeure

The Products offered comply with current French legislation. In addition, M'eye'R Trading cannot be held liable for any damage resulting from the Customer's misuse of the purchased Product. Similarly, M'eye'R Trading cannot be held liable in the event of non-performance or improper performance of the contract due to the Client's fault. As such, M'eye'R Trading declines all responsibility and can in no case be incriminated for errors, omissions or spelling or typing errors in the documents provided by the Client. Finally, M'eye'R Trading cannot be held liable for any inconvenience or damage inherent to the use of the Internet network, in particular a service interruption, an external intrusion or the presence of computer viruses. M'eye'R Trading's performance of all or part of its obligations will be suspended in the event of force majeure that would hinder or delay its performance. Are considered as such the different cases recognized by French case law. In such a case, M'eye'R Trading will inform the Client by email within seven days of the occurrence of the event. The computerized records, kept in M'eye'R Trading's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments made between the Client and M'eye'R Trading. The archiving of purchase orders and invoices is carried out on a reliable and durable medium in order to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.

Article 11 - Dispute resolution

11.1. Complaint.

11.2 Mediation.

In the event of failure of the complaint request to the customer service or in the absence of a response from this service within two months, the Customer may submit the dispute relating to the application, interpretation or execution of these General Terms and Conditions of Sale, the purchase order or the payment of the price, opposing M'eye'R Trading to a mediator who will attempt, in complete independence and impartiality, to bring the parties together in order to reach an amicable solution. The parties to the contract remain free to accept or refuse the use of mediation and, in the event of mediation, to accept or refuse the solution proposed by the mediator.

11.3 Territorial jurisdiction and applicable law.

These General Terms and Conditions of Sale are subject to French law. The language of the contract concluded between the Client and M'eye'R Trading is French. Also, in the event of a dispute concerning the application, interpretation or execution of these General Terms and Conditions of Sale, the purchase order or the payment of the price, the competent court shall be that of the defendant's place of residence or that of the actual delivery of the Product.

Article 12 - Intellectual property

All the elements of the www.9five-europe.com website are and remain the intellectual and exclusive property of M'eye'R Trading. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site, whether visual or audio, or the underlying technology. These elements are protected by copyright, trademark and patent law. Any simple or hypertext link is strictly prohibited without the express prior written consent of M'eye'R Trading. Any reproduction, exploitation, distribution, or use for any purpose whatsoever, even partially, of the elements of the Website, whether visual or audio, or even of the underlying technology, without the express and prior authorization of M'eye'R Trading exposes the offenders to legal proceedings. The sale of the Products does not in any way imply an assignment, to the benefit of the Client, of intellectual property rights and in particular all copyrights, designs, models, trademarks and patents attached to the Products and of which M'eye'R Trading is the exclusive owner. Any reproduction, exploitation, distribution or use for any purpose whatsoever, even partially, of all or part of the intellectual property rights attached to M'eye'R Trading Products, without the express prior authorization of M'eye'R Trading, exposes the Client to legal proceedings and incurs its liability.

Article 13 - Confidentiality of personal data

The information requested from the Customer is necessary for the processing of the order.
